$15,000,000 Settlement – Negligent Security / Sexual Assault
Shiver Hamilton Campbell obtained a $15,000,000 settlement on behalf of a sexual assault victim. Our client was sexually assaulted in her apartment after being awakened by a stranger at the foot of her bed.
The assailant had been allowed to live in the complex, even though he had a criminal history. The apartment complex denied knowing the assailant was living on the property. Through its investigation, Shiver Hamilton Campbell found former employees of the apartment complex who testified they knew the assailant lived on the property and had even told the property manager about the assailant. During the investigation, it was also discovered that window latches at the complex were faulty, and it is believed the assailant entered through a window.
Throughout the litigation, we defeated three separate motions for summary judgment and a motion to exclude our expert witness.
The insurance companies initially denied the claim and offered nothing. After we secured the testimony of witnesses and discovered the faulty window latches, and as the court was preparing him to place this case on a trial calendar, the defendants and three different insurance companies agreed to settle the case for $15,000,000.
