$2,950,000 Settlement – Sexual Assault At Apartment Complex

Shiver Hamilton Campbell filed suit on the young lady’s behalf and conducted a thorough investigation, including taking the depositions of multiple witnesses. During this process, our attorneys learned that the apartment management company had actual notice of an armed robbery that occurred at the complex a few days before the sexual assault. It was also discovered that several tenants told property management that the robber fit the description of someone living at the complex. The management company was told about the armed robbery the very day our client signed a lease yet failed to put her on notice of the crime.
It is an accepted practice in the apartment management industry to notify tenants of crime occurring on the property. We argued that the apartment management company should have let our client know this before she signed a lease. We also learned that the apartment management company failed to conduct a criminal background check on the perpetrator.
The insurance company initially offered zero and denied the claim altogether. Prior to trial, the parties settled the case for $2,950,000.
