$800,000 Settlement – Commercial Motor Vehicle Collision
Our elderly client was rear-ended by a commercial vehicle while he was stopped for traffic. The client, who had a complex medical history including two coronary artery bypass surgeries, reported at the scene that he was not injured. The client subsequently began to experience headaches and was diagnosed with a subdural hematoma necessitating discontinuance of his heart medications. Over the subsequent couple months the client’s condition deteriorated and he ultimately passed away from a heart attack. The defendants denied any connection between the seemingly mild collision and the client’s death by heart attack more than two months later. Through critical review of the available medical evidence, meeting with the medical providers involved, and consultation with outside medical experts, we were able to marshal the medical evidence necessary to fundamentally change the defendants’ assessment and efficiently resolve the case on favorable terms without protracted litigation.
